This website (“Platform”) is operated by UNITED DIGITAL TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the laws of India (“Company”,“we”,“us”,or“our”). This privacy policy (“Privacy Policy”) succinctly describes how we collect and use your information through a variety of digital means. By way of the Platform, the Company is, inter alia, engaged in the business of facilitating the sale and distribution of digital gift vouchers / gift cards / e-codes issued by third-party brands and merchants (“Brand Partners”), and related customer support and communication (collectively, the “Services”). The Company does not operate any wallet, stored-value account, or prepaid payment instrument, nor does it accept deposits or provide any financial, investment or return-bearing product. This Privacy Policy is incorporated into, and is subject to, the Terms of Use of the Platform.

INFORMATION THAT IS OR MAY BE COLLECTED FROM YOU

We may automatically receive and collect certain information in standard usage logs through our servers, including computer-identification information obtained from “cookies” sent to your browser from various sources, as detailed in the Cookie Policy section and/or separate cookie notice on the Platform.

All sensitive payment information (for example, card, UPI or net-banking credentials) will be obtained and processed by our online payment partners and payment gateways. They have access to personal data needed to perform their functions but may not use it for other purposes and are required to process personal data in accordance with this Privacy Policy and applicable law.

We may work with third-party analytics services to help us understand how this Platform is being used, such as tracking the frequency and duration of visits and the manner of interaction with content and features. We may actively collect information from you on our Platform during registration / login, and while you are availing of different classes of vouchers or Services provided by us, including for the purposes of authentication, authorisation, fraud checks and support.

PURPOSE AND METHOD OF USING INFORMATION COLLECTED

  • Performance of a contract – when we provide you with vouchers or Services, or communicate with you about them. This includes taking and handling orders, issuing and delivering vouchers, and processing payments.
  • Our legitimate business interests and the interests of our customers – for improving our Services, including personalisation of your experience; detecting and preventing fraud and abuse in order to protect the security of our customers, ourselves or others; and providing you with offers or communications that may be of interest.

JURISDICTION

If you access or use the Platform, you agree that your visit and any dispute relating to privacy shall be governed by and construed in accordance with this Privacy Policy and the Platform’s Terms of Use. Regardless of your place of residence, you hereby consent to your personal data being transferred to, processed and stored in India in accordance with applicable law.

Any dispute, claim or controversy arising out of or in connection with this Privacy Policy, including any question regarding its existence, validity, interpretation, breach or termination, shall be first attempted to be resolved amicably. Failing such amicable resolution within 7 days, the dispute shall be finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitral tribunal shall consist of a sole arbitrator appointed in accordance with the said Act. The seat and venue of arbitration shall be Karnataka, India, the proceedings shall be conducted in the English language, and the award of the arbitrator shall be final and binding on the parties.

Subject to the foregoing arbitration clause, and for the purposes of seeking interim or conservatory relief or the enforcement of any arbitral award, the courts at Karnataka, India shall have exclusive jurisdiction. This Privacy Policy shall, in all respects, be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
